BrokerStacks (“BrokerStacks”, “we”, “our”, “us”) operates an AI-powered WhatsApp automation and lead management platform for real estate brokers, along with internal support tools such as Chatwoot. This Privacy Policy explains how information is collected, used, stored, and processed when you use BrokerStacks, our website, dashboards, APIs, WhatsApp integrations, and support systems. By using BrokerStacks, you agree to the practices described in this policy.

2. Roles & Responsibility (Important)

BrokerStacks acts primarily as a data processor, not a data controller.

  • Brokers are the data controllers of their customers’ data
  • BrokerStacks processes data strictly on the broker’s behalf
  • End users (leads) interact with brokers, not directly with BrokerStacks

Brokers are solely responsible for: Obtaining user consent, Complying with local data protection laws, The content they send or automate. BrokerStacks is not responsible for how brokers use the platform.

3. Information We Process

3.1 Information provided by brokers

Name, phone number, email, Business details, WhatsApp numbers, Google Sheets or CRM references, Configuration settings, AI instructions and prompts.

3.2 Information processed from end users (leads)

Processed on behalf of brokers:

  • Phone numbers, WhatsApp messages, Property preferences, Conversation history
  • Metadata required for message delivery

We do not sell or independently use this data.

4. AI & Automated Processing

BrokerStacks uses AI models (including third-party APIs such as OpenAI) to:

  • Understand messages, Generate replies, Route conversations, Summarize or score leads

AI responses are probabilistic. BrokerStacks does not guarantee accuracy. Brokers must verify AI outputs before acting on them. AI is used only to assist, not replace human judgment.

5. Chatwoot (Support & Internal Communication)

BrokerStacks uses Chatwoot as a customer support and conversation management tool. Chatwoot may process support messages, email addresses, names, and conversation logs related to support or troubleshooting.

6. WhatsApp & Third-Party Platforms

BrokerStacks integrates with WhatsApp Business Platform (via providers such as Gupshup), Cloud providers, and Analytics services. WhatsApp conversations are governed by WhatsApp’s Privacy Policy and Meta’s platform policies.

7. Data Storage & Security

We implement technical safeguards including encrypted connections and access controls. However, no system is 100% secure. Use of the platform is at your own risk.

8. Data Retention

Data is retained only as long as necessary. Brokers may request deletion of their data. End-user data retention is controlled by the broker.

9. Payments & Billing

Payment information is processed through third-party providers. BrokerStacks does not store full payment credentials.

10. Children’s Data

BrokerStacks is not intended for individuals under 18. We do not knowingly collect children’s data.

11. Legal Disclaimers

BrokerStacks provides services “as is”. We make no warranties regarding uptime, accuracy, or fitness for purpose. Total liability is limited to the amount paid to BrokerStacks in the preceding billing period.

12. Compliance & Jurisdiction

BrokerStacks operates only in India. Users are responsible for complying with DPDP and local data protection laws.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Continued use of the platform constitutes acceptance of the updated policy.
